Leasing - o utilizare plătită pe termen a proprietății pe baza unui contract, care este necesară pentru ca locatarul să desfășoare activități antreprenoriale și alte activități.
Entitatea care a închiriat proprietatea se numește chiriaș, iar cel care a furnizat proprietatea este proprietarul. Relația dintre locatar și locator este determinată de contractul de închiriere. Acordul privind transferul obiectului închiriat de către chiriaș către un terț se numește subînchiriere. Metodologia de contabilizare a relațiilor de leasing este stabilită de P (S) BU 14 "Chirie".
Un contract de leasing operațional este un contract de leasing diferit de un contract de leasing financiar.
Subînchiriere - un acord privind transferul obiectului închiriat de către chiriaș către o terță parte.
Un leasing financiar este un contract de leasing care transferă locatarului toate riscurile și recompensele aferente dreptului de utilizare și deținere a unui activ. Un leasing este considerat un leasing financiar dacă este prezentă cel puțin una dintre următoarele caracteristici:
Locatarul dobândește dreptul de proprietate asupra activului închiriat după încheierea termenului de leasing;
Locatarul are capacitatea și intenția de a achiziționa elementul închiriat la un preț sub valoarea sa justă la data achiziției;
Termenul de închiriere este cea mai mare parte a duratei de viață utilă (funcționare) a obiectului închiriat;
Valoarea actualizată a plăților minime de leasing de la începutul termenului de leasing este egală sau mai mare decât valoarea justă a articolului închiriat.
Proprietatea transferată în baza contractului de leasing operațional rămâne în bilanțul locatorului. La locatar, astfel de proprietăți sunt înregistrate în bilanț. Proprietatea transferată în cadrul unui contract de leasing financiar este creditată în bilanțul locatarului. Transferul și returnarea obiectului închiriat este formalizat printr-un act de acceptare și transfer.
Activele fixe transferate într-un contract de leasing operațional rămân în bilanțul locatorului și sunt contabilizate în contul 10 „Active fixe” cu alocarea în registrele analitice către un grup separat, în care se observă că aceste obiecte sunt transferate unui contract de leasing operațional .
Locatarul înregistrează obiectele închiriate în contul din afara bilanțului 01 „Active imobilizate închiriate”. El trebuie să aibă o copie a fișei de inventar sau un extras din cartea de inventar atașat de locator la certificatul de acceptare a obiectelor închiriate. Aceste cărți sunt păstrate separat de chiriaș. După restituirea obiectului de închiriere către locator, chiriașul îl scoate din bilanț, ia o copie a cardului corespunzător din cabinetul de dosare și, împreună cu certificatul de acceptare, îl înregistrează în documentele pentru actualul lună. Atunci când transferă un obiect pentru închiriere, destinatarul acordă locatorului o procură pentru a primi obiecte de valoare. Returul unui obiect din contractul de leasing este, de asemenea, procesat folosind o procură.
Locatorul (proprietarul) calculează amortizarea în funcție de ratele stabilite pentru obiectele închiriate: debitul contului 23 „Producție” (un cont secundar separat pentru contabilizarea costurilor serviciilor de închiriere) și creditul contului 13 „Amortizarea (amortizarea) activelor fixe ". În plus față de amortizare, alte cheltuieli legate de funcționarea obiectului închiriat sunt, de asemenea, încasate în debitul contului 23, dacă sunt efectuate de locator. Cheltuielile locatorului legate de încheierea contractului de închiriere (servicii juridice, comisioane) sunt recunoscute ca alte cheltuieli de exploatare din perioada de raportare în care au avut loc. Din contul 23, cheltuielile sunt amortizate lunar în debitul subcontului.
Dacă locatorul primește chiria în avans, o reflectă mai întâi ca parte a venitului amânat: contul de debit 31 „Conturi bancare” și contul de credit 69 „Venit amânat”. În același timp, se prezintă datoria fiscală pentru TVA: debitul subcontului 643 „Datorii fiscale”, creditul subcontului 641 „Calcule pentru impozite”. În lunile următoare, conform condițiilor contractului de leasing, se reflectă venitul din închiriere: debitul contului 69, creditul contului secundar. Datoria fiscală pentru TVA este creditată: debitul subcontului 713, credit al subcontului 643.
Veniturile din leasingul operațional sunt recunoscute ca alte venituri operaționale pentru perioada de raportare respectivă. Subcontul este debitat și subcontul 713 „Venituri din leasingul operațional al activelor” este debitat pe suma chiriei care urmează să fie primită. Taxa pe valoarea adăugată pentru relațiile de leasing este contabilizată în modul prescris.
Suma chiriei datorate în temeiul contractului este inclusă în cheltuielile lunare de către locatar: debitul conturilor 23, 91, 92, 93, 94 (în funcție de locul de utilizare a obiectului închiriat) și creditul contului 68 " Decontări pentru alte tranzacții ". Rambursarea restanțelor chiriei - contul 68 debit și contul 31 de credit „Conturi bancare”.

Atunci când se contabilizează contractele de leasing, atât în conformitate cu standardele rusești, cât și cu cele internaționale, serviciile financiare ale companiilor au multe întrebări. Cum să o clasificăm? Cine ar trebui să arate proprietatea în bilanțul lor - locatorul sau locatarul? Cum se distribuie veniturile și cheltuielile între perioadele de raportare? În acest articol, vom analiza diferențele de abordare pentru rezolvarea acestor probleme oferite de IFRS și RAS.
Chirie: operațional sau financiar?
Pentru a reflecta corect leasingul în contabilitate, în primul rând, este necesar să aflăm la ce tip de leasing aparține: operațional sau financiar, adică leasing.
Să începem cu legislația rusă. Pentru a răspunde la această întrebare, trebuie să vă referiți la Legea federală din 29 octombrie 1998 nr. 164-FZ "Cu privire la leasingul financiar (leasing)" (în continuare - Legea leasingului). Potrivit acestuia, conținutul contractului de închiriere ar trebui să fie după cum urmează. Locatorul achiziționează proprietatea pe care arendașul a ales-o de la un anumit vânzător. Proprietarul trebuie să ofere chiriașului această proprietate pentru posesie temporară și utilizare contra cost.
În consecință, relația de leasing în temeiul acestor acorduri este clasificată ca leasing. Toate celelalte ar trebui să fie considerate ca un alt contract de leasing, adică un contract de leasing operațional. Astfel, contractele de leasing sunt clasificate numai în funcție de modul de întocmire a contractului. Vă rugăm să rețineți: un producător nu poate acționa ca locator în raport cu propriile sale produse.
La rândul său, IFRS împarte leasingurile în leasinguri financiare și operaționale, în funcție de conținutul economic al tranzacției. În primul rând, trebuie să aflați cine suportă riscurile asociate deținerii unui activ și care beneficiază de utilizarea acestuia.
Astfel, standardele internaționale se referă la închirierea locațiilor de proprietate, toate riscurile și beneficiile economice din utilizarea cărora au trecut de la locator la locatar.
Semne „internaționale” de leasing
IFRS oferă 5 criterii prin care puteți afla dacă riscurile și beneficiile economice asociate activului închiriat au trecut de la un partener la altul:
1. Până la sfârșitul contractului, locatarul devine proprietarul activului. Deoarece proprietatea va rămâne la locatar pe întreaga durată de viață utilă, riscurile și recompensele îi vor reveni.
2. La sfârșitul termenului de leasing, locatarul are dreptul de a cumpăra activul la un preț care este semnificativ sub valoarea justă în momentul tranzacției. În acest caz, chiriașul, chiar și la încheierea unui contract de închiriere, trebuie să fie sigur că proprietatea îi va fi vândută. Adică, la sfârșitul termenului de închiriere, proprietatea asupra activului trebuie să treacă locatarului, deși acest lucru nu se datorează obligațiilor părților la contract.
3. Termenul de leasing reprezintă o parte semnificativă din viața utilă a activului. În acest caz, dreptul de proprietate asupra proprietății nu poate fi transferat locatarului. Dar, din moment ce va folosi facilitatea pentru cea mai mare parte a vieții sale utile, va primi și cea mai mare parte a beneficiilor economice.
Rețineți că IFRS nu stabilește criterii clare prin care este posibil să se determine cât de mult din viața unui activ este semnificativ. În practică, se folosește de obicei 75%. Cu toate acestea, nu uitați că aceasta este doar o valoare aproximativă. Nu indică întotdeauna că leasingul ar trebui clasificat ca fiind financiar.
4. Valoarea actualizată a plăților de leasing la data semnării contractului este egală cu prețul corect al activului sau constituie o parte semnificativă a acestuia (în practică, indicatorul este de 90%). Adică, în situația descrisă, chiriașul cumpără efectiv obiectul cu plata în rate.
5. Proprietatea este de așa natură încât numai locatarul o poate folosi fără modificări majore.
Deci arenda este clasificată. Dacă acesta este un leasing operațional, diferențele de contabilitate în cadrul RAS și IFRS vor fi nesemnificative. Dar regulile contabile pentru contractele de leasing financiar diferă fundamental.
Disputa echilibrului
Este necesar să aflați care dintre părțile la contractul de leasing financiar vor accepta proprietatea în bilanțul său.
În contabilitatea rusă, textul acordului va avea o importanță decisivă. La urma urmei, partenerii pot decide cu privire la subiectul leasingului de comun acord (articolul 31 din Legea leasingului).
În conformitate cu cerințele IFRS, dacă leasingul este clasificat ca leasing financiar, locatorul trebuie să anuleze proprietatea din bilanțul său. Locatarul trebuie să țină cont de valorile din sine. În contabilitatea rusă, activul poate rămâne în bilanțul locatorului prin acordul partenerilor. În acest caz, locatarul va contabiliza o astfel de proprietate într-un cont în afara bilanțului.
Contabilitatea contractelor de leasing financiar de către locatar ...
1. Recunoașterea inițială. La începutul termenului de leasing, locatarul trebuie să arate în bilanțul său activele primite și pasivele rezultate. În general, proprietatea este evaluată la valoarea justă. Dacă se dovedește a fi mai mare decât valoarea actualizată a plăților minime de leasing, se înregistrează în contabilitate valoarea sumei chiriei. Adică, proprietatea se reflectă la cel mai mic dintre cele două ratinguri (principiul conservatorismului).
Valoarea actuală a plăților minime de leasing este determinată pe baza ratei dobânzii implicite în leasing. Aceasta din urmă se mai numește și rata implicită - cea utilizată de locator în calcularea plăților de leasing. Desigur, în majoritatea cazurilor nu este cunoscut de chiriaș. Apoi, trebuie să utilizați rata dobânzii unui împrumut bancar, programul de plată pentru care ar corespunde termenilor contractului de închiriere.
Dacă valoarea actualizată a plăților minime de leasing este mai mică decât valoarea justă a proprietății, aceasta trebuie mărită la valoarea acesteia din urmă. Toate cheltuielile inițiale ale chiriașului vor fi incluse în suma la care va accepta proprietatea pentru contabilitate.
Regulile pentru reflectarea contractelor de leasing financiar în contabilitatea rusă diferă. Deci, dacă, în condițiile contractului, locatarul trebuie să accepte activul închiriat în bilanțul său, îl va lua în considerare la valoarea nominală a plăților de leasing. Adică, RAS nu ia în considerare valoarea în timp a banilor.
În IFRS, locatarul își arată obligațiile față de locator și la o valoare nominală. Dar, în același timp, introduce un cont suplimentar, care reflectă suma cheltuielilor viitoare cu dobânzile. Drept urmare, valoarea actualizată a datoriei va fi inclusă în bilanț.
2. Contabilitatea cheltuielilor. Conform IFRS, cheltuielile unui locatar constau în principal din două componente: amortizarea activului închiriat și cheltuielile cu dobânzile.
În RAS, părțile la acord pot aplica amortizarea accelerată a proprietății închiriate prin acord (articolul 31 din Legea leasingului).
Conform IFRS, locatarul trebuie să amortizeze activele închiriate conform regulilor pe care le aplică proprietăților similare. În același timp, el nu poate stabili amortizarea accelerată.
Cheltuielile cu dobânzile pentru proprietățile închiriate sunt recunoscute utilizând metoda dobânzii efective 1 similar cu dobânzile pentru pasivele pe termen lung ale companiei. Dar în contabilitatea rusă, cheltuielile cu dobânzile nu sunt afișate. Costurile de închiriere vor consta fie numai din plăți de leasing (atunci când se contabilizează proprietatea la locator), fie din amortizarea acumulată (atunci când se contabilizează locatarul).

... și proprietarul
1. Recunoașterea inițială.În cazul în care locatorul nu este un producător sau dealer al bunului închiriat, acesta trebuie să recunoască o „creanță” în bilanțul său atunci când activul este transferat. Regulile pentru evaluarea acesteia sunt aceleași ca și pentru datoria chiriașului: suma totală trebuie indicată la valoarea sa nominală. De asemenea, trebuie să introduceți un cont suplimentar pentru a contabiliza veniturile din dobânzi viitoare. Drept urmare, soldul va conține valoarea actualizată a datoriei. Acestea sunt cerințele IFRS. În ceea ce privește contabilitatea rusă, creanțele sunt reflectate în totalitate, adică la valoarea lor nominală.
2. Recunoașterea veniturilor. Atunci când sunt contabilizate de standardele internaționale, atât locatorul, cât și locatarul trebuie să înregistreze veniturile din dobânzi pe toată durata contractului de închiriere. Și trebuie să o facă sistematic și rațional. Rata profitului constant este repartizată între investiția netă restantă a locatorului în contractul de leasing. Acestea din urmă reprezintă diferența dintre valoarea nominală a datoriei și valoarea veniturilor din dobânzi care nu au fost încasate încă. Astfel, vorbim despre aceeași metodă a ratei dobânzii efective.
Conform regulilor RAS, un locator poate reflecta veniturile în două moduri. Alegerea dintre ei depinde de care dintre parteneri înregistrează proprietatea în bilanțul său - locatorul sau locatarul.
În primul caz, venitul locatorului va fi suma plăților de leasing în temeiul contractului. În al doilea rând, diferența dintre valoarea nominală a tuturor plăților și valoarea reală a activului transferat trebuie să fie atribuită venitului amânat. În contul de profit și pierdere, această sumă se reflectă pe baza condițiilor contractului de leasing și nu în mod uniform, ca în IFRS.
3. Contabilitatea leasingului comercial. Există o altă diferență importantă între IFRS și RAS. Este asociat cu așa-numitul leasing comercial. Ei vorbesc despre asta atunci când vânzătorul proprietății acționează ca locator. Adică, atunci când un contract de leasing este în esență o alternativă la cumpărarea unui anumit activ. Într-o astfel de situație, IFRS solicită locatorului să-și împartă veniturile în două tipuri:
- profit sau pierdere, care este echivalent cu venituri minus cheltuieli din vânzarea activului închiriat la prețuri de piață, luând în considerare toate reducerile - la data recunoașterii contractului de închiriere a proprietății;
- venituri din dobânzi - pe toată durata contractului de închiriere.
Spre deosebire de IFRS, conform legislației ruse, un producător de produse nu poate fi locator în același timp. În plus, RAS nu obligă dealerii să reflecte în contabilitate rezultatul financiar în temeiul contractului de închiriere de la data încheierii acestuia. Adică, procedura contabilă în acest caz nu va diferi de cea general acceptată.
Astfel, regulile contabile rusești pentru contractele de leasing financiar diferă semnificativ de cele internaționale. În primul rând, datorită faptului că procedura contabilă este în mare măsură determinată de specificul unei anumite tranzacții, adică de condițiile contractului de închiriere. Atunci când se contabilizează acest tip de leasing în conformitate cu IFRS, este necesar să se respecte principiul priorității conținutului economic al acordului asupra formei sale. Diferențele în contabilitatea contractelor de leasing financiar se datorează, de asemenea, faptului că nu există un concept de valoare temporală a banilor în RAS. Prin urmare, companiile naționale nu pot aloca în mod uniform veniturile din dobânzi și cheltuielile de închiriere pe baza ratei efective a dobânzii.

Relațiile de închiriere sunt o practică foarte obișnuită în antreprenoriat. Intrând în ele, trebuie să vă amintiți că leasingul trebuie să fie rezervat corect. Multe tranzacții, inclusiv aceasta, sunt guvernate de standardele internaționale IAS. În contabilitatea internă, nu există un plan de conturi separat pentru contabilitatea leasingului, cu toate acestea, în RAS și IFRS, leasingurile operaționale sunt contabilizate în același mod. Cum se întâmplă exact acest lucru și cum diferă un leasing operațional de unul financiar, vom descrie mai detaliat mai jos.
Ce este un leasing operațional
La sfârșitul anului 2016, Ministerul Finanțelor al Federației Ruse a emis Ordinul nr. 258n, care a aprobat Standardul Federal de Contabilitate „Chiria” destinat întreprinderilor din sectorul public. Acest standard prevede că leasingurile pot fi leasinguri operaționale sau leasinguri financiare.
Relația de închiriere- aceasta este achiziționarea sau acordarea pentru funcționarea temporară sau deținerea temporară a oricăror valori materiale. În același timp, ambele părți primesc anumite avantaje:
- locatorul își păstrează proprietatea asupra valorii materiale sau o poate vinde la sfârșitul perioadei de leasing, în timp ce i se garantează încasări suplimentare în numerar;
- chiriașul nu cheltuiește bani pentru achiziționarea proprietății, dar îi poate folosi;
- bonusuri fiscale pentru ambele părți.
PENTRU INFORMAȚIA DUMNEAVOASTRĂ! Intrarea într-o relație de închiriere este sigilată prin încheierea unui contract de închiriere a proprietății (așa-numitul „contract de închiriere”) sau a unui contract de utilizare gratuită.
Standardul IFRS împarte contractele de leasing în leasingurile operaționale și cele neoperatorii (financiare). Leasing operational- transferul proprietății cu o perioadă relativ scurtă de utilizare sau deținere temporară, care este semnificativ mai mică decât durata de viață utilă (același raport din punct de vedere al costului: chiria este mult mai mică decât prețul real al valorii materiale transferate). Plățile în temeiul contractului de închiriere nu vor acoperi valoarea totală a activelor primite, ele reprezintă doar plata pentru utilizarea lucrului, dar nu și pentru lucrarea în sine.
O NOTĂ! Când termenul „leasing” este utilizat în sensul său obișnuit de zi cu zi, cel mai adesea înseamnă doar un leasing operațional - este mai frecvent decât unul financiar. Un exemplu este, de exemplu, închirierea unui birou într-un centru de afaceri sau închirierea unui apartament de către o persoană fizică.
Diferența dintre leasingul operațional și leasingul financiar
Leasing financiar- un alt tip de transfer temporar de active, atunci când plățile pentru leasing și perioada de utilizare practic „fuzionează” cu durata totală de viață a activelor materiale și valoarea reală a acestora. În ce se deosebește de sala de operație?
- Riscuri și beneficii... Aceasta este principala diferență între această formă de contract de leasing față de un contract de exploatare: într-un contract de leasing financiar, destinatarul acceptă, împreună cu proprietatea, toate beneficiile din posesia sa, dar cu ele toate riscurile. În exploatare, beneficiile proprietății și riscurile asociate acesteia nu sunt transferate în totalitate.
- Închiriați sau închiriați? O altă diferență are legătură cu contabilitatea leasingului. Contractele de leasing operațional sunt tratate în mod egal în conformitate cu IFRS și RAS. Cu toate acestea, situația financiară este luată în considerare numai în clauza 13 din GHS „Chirie”, iar în Standardele de contabilitate rusești se folosește în schimb termenul „leasing”. Leasingul ar trebui să fie luat în considerare în contabilitate în conformitate cu reglementările legii relevante („Despre leasing”), care diferă de standardul IAS.
- Înțelesul este mai important decât forma. Acest principiu, care se definește în standardizarea internațională, este foarte clar ilustrat chiar de clasificarea relațiilor de leasing: forma acordului întocmit nu este atât de importantă în calificarea leasingului ca esență economică a acestei operațiuni. Raportul dintre riscuri și beneficii va fi o prioritate în determinarea tipului de leasing - financiar sau operațional.

Reflectarea leasingului operațional în contabilitate
Din punct de vedere contabil, un leasing operațional este o vânzare normală de servicii cu singura diferență - bilanțul contine o linie separată pentru plata în avans a leasingului, care este numită diferit de către părți:
- pentru locator, acesta este „Venit amânat”;
- de la destinatarul contractului de leasing - „Cheltuieli amânate”.
IMPORTANT! La contabilizarea unui contract de leasing operațional, toate plățile trebuie acumulate în mod egal, adică în aceeași sumă pe toată durata contractului de leasing. În același timp, programul de plată adoptat în textul acordului nu contează: un contract de leasing operațional garantează o primire uniformă a beneficiilor.
Ce să reflectăm în contabilitatea locatarului
Partea care ia proprietatea într-un contract de leasing operațional trebuie să reflecte în contabilitate următoarele obiecte:
- pe noul cont de sold 0 111 40 000 „Dreptul de utilizare a proprietății” - drepturile de exploatare a activului (suma plăților de leasing pentru întreaga perioadă de leasing);
- în contul de sold 0 302 24 000 „Decontări privind chiria pentru utilizarea proprietății” - bani destinați chiriei;
- în contul noului sold 0 104 40 450 "Amortizarea dreptului de utilizare a proprietății" - amortizarea dreptului la utilizarea temporară a activului este anulată (lunar în suma plăților de leasing);
- pe conturile corespunzătoare de contabilitate analitică (0 302 00 000 „Datorii”, 0 109 00 000 „Costuri de fabricație a produselor finite, executarea lucrărilor, servicii”, 0 401 20 000 „Cheltuieli ale exercițiului financiar curent”) - costul a plăților contingente care apar la data acumulării lor (de regulă, acest lucru se întâmplă lunar). Plățile condiționate sunt acele cheltuieli care apar în procesul de utilizare a proprietății și nu sunt fixate în textul acordului, cuantumurile acestora sunt determinate pe parcurs.
NOTĂ!„Dreptul de utilizare a proprietății” este un obiect contabil nou, independent, înregistrat ca activ nefinanciar. Valoarea sa reziduală poate fi inversată în direcția reducerii datoriilor la plățile de leasing dacă suma leasingului a fost plătită înainte de termen, în timp ce profitul suplimentar, desigur, nu este reflectat.
Caracteristici ale contabilității cu locatorul
Contabilitatea tratează leasingul ca dobândirea dreptului de utilizare pentru o perioadă determinată.
Partea care își transferă bunurile în posesia sau funcționarea pentru perioada specificată în contract are următoarele obiecte în evidența sa contabilă:

După cum puteți vedea, activele cedate nu sunt anulate din bilanț, ci rămân în cont, modificările sunt vizibile doar în contul analitic.
ATENŢIE!În cazul în care leasingul este rambursat înainte de termen, soldul veniturilor prognozate din cont este inversat într-o reducere a leasingului de primit de la beneficiarul activului, fără recunoașterea pierderii.
Contabilitate fiscală pentru leasingurile operaționale
Orice tranzacție de leasing este supusă impozitării la 18%, care în acest caz se calculează pe veniturile din leasingul operațional. Suma se calculează pe baza rezultatului financiar înregistrat în departamentul de contabilitate.
NOTĂ! TVA nu se percepe la transferul activului în sine, ci doar la plățile de închiriere. În momentul transferului activului, părțile nu au obligații de plată a TVA.
Nu se acumulează deoarece activul nu este debitat din bilanțul locatorului și nu mărește venitul locatarului. Există multe motive pentru a alege un leasing operațional în comparație cu alte tipuri de leasing sau pentru a cumpăra un activ direct.
În cazul unui contract de leasing operațional, durata contractului este, în general, semnificativ mai scurtă decât durata de viață utilă a bunului închiriat. Acest tip de închiriere este ideal pentru chiriașii care au nevoie să folosească orice proprietate fără a o cumpăra. Deținerea unei proprietăți implică de obicei multe responsabilități și riscuri care pot fi inacceptabile. Un contract de leasing operațional oferă mult mai multă flexibilitate, ceea ce poate fi foarte benefic pentru chiriaș, iar un contract de închiriere bine scris poate reduce costul de a face afaceri.
Opusul unui leasing operațional este un leasing financiar, al cărui contract implică un transfer parțial de proprietate. Există mai multe criterii care permit clasificarea unui leasing ca leasing financiar. Cu toate acestea, trebuie remarcat faptul că aceste criterii sunt stabilite prin lege în diferite țări și pot varia semnificativ. De exemplu, în Statele Unite, un contract de leasing financiar trebuie să îndeplinească patru criterii principale:
- contractul trebuie să prevadă dreptul locatarului la proprietatea miliției asupra activului la sfârșitul contractului de închiriere;
- prețul de răscumpărare trebuie să fie mai mic decât valoarea curentă de piață a activului (la data expirării contractului);
- durata contractului trebuie să fie cel puțin egală cu 75% din durata de viață utilă a activului;
- totalul tuturor plăților de leasing trebuie să fie de cel puțin 90% din suma inițială plătită de locator la momentul achiziționării activului.
De asemenea, leasingurile financiare și operaționale sunt raportate diferit în situațiile financiare și fiscale și în alte situații de informații financiare. Deoarece aceste diferențe sunt semnificative, în multe țări criteriile pentru calificarea unui contract ca leasing operațional sau financiar sunt clar definite prin lege. Acest lucru este deosebit de important pentru companiile cotate la bursă, deoarece reputația lor depinde de curățenia și transparența situațiilor financiare.
Termenii și condițiile unui contract de leasing operațional pot varia considerabil, astfel încât examinarea și evaluarea atentă a termenilor sunt extrem de importante pentru orice chiriaș. Dacă părțile au dezacorduri cu privire la termeni sau consideră că unele dintre formulările contractului de închiriere operațională sunt incorecte, trebuie să rezolve conflictul înainte de semnarea acordului și părțile își asumă anumite obligații. Contractele de leasing sunt utilizate sub formă de leasing operațional și leasing / leasing financiar. Este reglementat de IAS 17. Într-un contract de leasing operațional, activul se află în bilanțul locatorului, amortizat și depreciat în conformitate cu politicile sale contabile. Prin urmare, proprietarul suportă riscuri și recompense semnificative. Venitul din închiriere nu este redus. Chiria plătită de locatar reprezintă costurile curente de închiriere și este inclusă în costuri în conformitate cu schema de venituri din închiriere. Finanțarea pentru costul reparării obiectului este determinată de acordul părților. Contractele de leasing operațional pot fi pe termen scurt sau pe termen lung (peste un an).
Într-un contract de leasing financiar, locatarul (locatarul) folosește obiectele închiriate pentru a produce, vinde, primi venituri - dar suportă și riscurile asociate obiectului închiriat (amortizare, reparație, dezavantaj). În acest caz, obiectul este proprietatea locatorului (locatorului), iar locatarul îl deține doar. Desigur, el poate cumpăra obiectul la sfârșitul termenului de închiriere, dar înainte este obligat să plătească întreaga chirie locatorului, adică prin plata efectivă a obiectului de închiriere.
Leasingul protejează interesele locatorului, prin urmare contractul de leasing este irevocabil pentru locatar (doar locatorul îl poate modifica), leasingul conține valoarea justă a activului și dobânda (instrumentul financiar de credit), termenul leasingului este lung (mai mult de jumătate) din viața utilă a activului), deprecierea este recunoscută de locatar. Dacă indicatorii enumerați sunt absenți, atunci contractul de leasing din situațiile financiare este recunoscut ca operativ, indiferent de durata acestuia. În general, clasificarea unui contract de leasing depinde de conținutul economic real al tranzacției și nu numai de forma juridică a acesteia. Închirierea nu se aplică resurselor naturale și mai multor bunuri (filme, videoclipuri, piese de teatru, manuscrise, drepturi de autor). Pentru aceste obiecte, drepturile de închiriere se aplică sub formă de concesiuni și redevențe. Închirierea terenului este considerată a fi una operațională, dar dacă este asociată cu o achiziție, atunci este financiară.
De ce se utilizează leasingul în afaceri, în ciuda fluxului de numerar, care acoperă în cele din urmă (de 2-3 ori) costul unei achiziții unice a unui obiect? Faptul este că obiectul închiriat este un echipament foarte specializat, care nu este disponibil pe piața liberă. Acesta este comandat de chiriaș pentru a beneficia de lansarea și vânzarea de produse noi și pentru a ocupa o nouă nișă de piață. Înainte de începerea contractului de închiriere, managerul chiriașului răspunde la întrebarea cu privire la proprietatea obiectului după încheierea contractului de închiriere: fie este returnat locatorului, fie este cumpărat de chiriaș. Locatarul va fi primul din coada de răscumpărare, dar va răscumpăra la prețul pieței, ținând cont de deprecierea obiectului. Această parte a contractului de închiriere ar trebui decisă în prealabil, deoarece obiectul este depreciat ca al său. Incertitudinea poate sta în perioada de amortizare. Dacă locatarul nu este sigur cu privire la dreptul de a răscumpăra obiectul, începutul amortizării este cea mai timpurie dintre date: încheierea contractului / începutul utilizării utile a activului. Chiria conține valoarea obiectului și procentul de închiriere:
Chirie = plăți minime de leasing (MLP) + dobândă de leasing
MLP înseamnă valoarea nominală, care se calculează la rata ratei dobânzii interne / a ratei dobânzii interne / a ratei efective (rata internă a dobânzii, IIR; rata internă de rentabilitate, IRR; rata efectivă) a întregii chirii; dacă nu se cunoaște o astfel de rată, se aplică rata capitalului împrumutat. Costurile inițiale ale gestionării leasingului sunt recunoscute ca fiind curente la locator, dar sunt incluse în valoarea contabilă a locatarului (pentru un contract de leasing operațional, invers - în valoarea contabilă a locatorului și I în costurile curente ale locatarului) .
În cazul în care activul închiriat nu este transferat în bilanțul locatarului, dar rămâne în bilanțul locatorului, atunci nu se percepe amortizarea, iar chiria se reflectă în schimb. Această schemă poate fi benefică pentru locator dacă se teme de riscul pierderii activului (posibilul faliment al locatarului, instabilitatea economiei regionale). Dar această abordare înseamnă o abatere de la IAS 17. Este permisă doar pentru o prezentare fiabilă a activităților companiei în situațiile sale, iar în politica contabilă abaterea este prezentată cu calculul impactului financiar (IAS 1).
În general, abordarea actuarială se numește investiția brută în metoda leasingului, iar transferul veniturilor din amânat în leasingul curent pentru fiecare perioadă de raportare se numește investiția netă în leasing.
Există, de asemenea, un leaseback, în care un activ este mai întâi vândut și apoi luat înapoi, dar închiriat (operațional / leasing). Această schemă are o serie de avantaje pentru locatar: primirea integrală a plății în numerar și recunoașterea veniturilor și profiturilor din vânzarea activului. Costurile leasingului vor reduce profiturile, dar beneficiile leasingului pot fi mai mari. Nu este interzis de IAS 17, dar este reglementat astfel încât excesul de venituri peste valoarea contabilă a obiectului să fie recunoscut ca venit amânat al locatarului și să fie inclus în profit nu imediat, ci pe durata termenului de leasing. La o vânzare sub valoarea justă, pierderea este recunoscută imediat.
Leasingul este un proces financiar complex. Locatarul va ajunge să plătească mai mult pentru activ decât dacă l-ar fi cumpărat, în timp ce locatorul se teme de riscurile pierderii activului. Prin urmare, managerul chiriașului calculează dacă ar fi mai ieftin să cumpere un activ printr-un împrumut, iar managerul locatorului se gândește la schema de leasing, la venituri și la posibilele riscuri. O modificare a formei de leasing este considerată o modificare a politicii contabile, ceea ce înseamnă o retratare retrospectivă a situațiilor financiare.
